1. Acceptance of Terms
By downloading, installing, accessing, or using the MedNest platform (website and mobile applications for iOS and Android, collectively the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services. These Terms constitute a legally binding agreement between you and MedNest.
2. Description of Service
MedNest is a healthcare management platform that connects patients with qualified practitioners and clinics. Our services include:
- Appointment booking and scheduling management.
- Secure payment processing for medical services.
- Patient health profile and medical record management.
- Communication tools between patients and healthcare providers.
- Invoice payment processing for practitioner and clinic services.
- Push notifications for appointment reminders and updates.
MedNest is a technology platform and does not provide medical advice, diagnoses, or treatment. All medical services are provided by independent licensed practitioners.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. Parents or legal guardians may create accounts and book appointments on behalf of minor children. By using the Platform, you represent that you meet these eligibility requirements.
4. User Accounts
To use certain features, you must create an account. You are responsible for:
- Providing accurate, current, and complete registration information.
- Maintaining the confidentiality and security of your account credentials.
- All activities that occur under your account.
- Notifying us immediately of any unauthorized use of your account at support@mednest.ky.
We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.
5. Patient Responsibilities
As a patient using the Platform, you agree to:
- Provide accurate personal and medical information for safe and effective care.
- Arrive on time for scheduled appointments or cancel within the required notice period.
- Pay all fees associated with booked appointments and services.
- Treat practitioners, clinic staff, and other users with respect.
- Not use the Platform for emergency medical situations (call emergency services instead).
- Comply with all applicable laws and regulations.
6. Practitioner Responsibilities
As a practitioner using the Platform, you agree to:
- Maintain valid, current professional licenses and certifications as required by applicable law.
- Provide accurate information about your qualifications, specialties, and services.
- Deliver services in accordance with professional standards of care and applicable regulations.
- Honor confirmed appointments or provide timely notice of changes.
- Maintain patient confidentiality in accordance with applicable healthcare privacy laws.
- Not use the Platform to provide services outside your area of licensure.
7. Appointment and Cancellation Policy
- Appointments must be cancelled at least 24 hours in advance (or as specified by the practitioner/clinic).
- Late cancellations or no-shows may be subject to cancellation fees as determined by the practitioner or clinic.
- Practitioners who repeatedly cancel confirmed appointments may have their accounts reviewed or suspended.
- MedNest is not responsible for the availability or quality of services provided by practitioners.
8. Payment Terms
- All payments are processed securely through our PCI-compliant payment gateway.
- Fees are displayed at the time of booking and must be paid to confirm appointments.
- MedNest charges a platform service fee which is included in the total amount displayed at checkout.
- Refunds are subject to our refund policy and the individual practitioner or clinic cancellation terms.
- You agree to pay all applicable taxes associated with your use of the Platform.
- For subscription-based services, charges will recur according to the subscription terms until cancelled.
9. In-App Purchases and Subscriptions
Certain features or services may require in-app purchases or subscriptions. By making a purchase:
- You authorize MedNest to charge the payment method associated with your account.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- You can manage and cancel subscriptions through your device settings (App Store or Google Play) or within the app.
- Refunds for in-app purchases are subject to the policies of Apple App Store or Google Play Store, as applicable.
10. Intellectual Property
All content on the MedNest platform, including but not limited to text, graphics, logos, icons, images, audio, video, software, and source code, is the property of MedNest or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not:
- Reproduce, distribute, modify, or create derivative works without our express written consent.
- Reverse engineer, decompile, or disassemble any part of the Platform.
- Use our trademarks, logos, or branding without prior written authorization.
- Scrape, harvest, or extract data from the Platform using automated means.
11. User-Generated Content
You may submit reviews, ratings, feedback, and other content through the Platform. By submitting content, you:
- Grant MedNest a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content.
- Represent that your content is accurate, does not violate any third-party rights, and complies with applicable laws.
- Agree not to submit content that is defamatory, obscene, harassing, or otherwise objectionable.
We reserve the right to remove content that violates these Terms.
12. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful, fraudulent, or unauthorized purpose.
- Impersonate any person or entity, or misrepresent your affiliation.
- Interfere with or disrupt the Platform, servers, or networks.
- Attempt to gain unauthorized access to other users' accounts or data.
- Upload malware, viruses, or other harmful code.
- Use the Platform to spam, solicit, or send unsolicited communications.
- Circumvent, disable, or interfere with security features of the Platform.
13. Disclaimer of Medical Advice
MedNest is a technology platform and does not provide medical advice, diagnosis, or treatment. The Platform is not a substitute for professional medical advice. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition. Never disregard professional medical advice or delay seeking treatment because of something you read on the Platform. In case of a medical emergency, call your local emergency services immediately.
14. Limitation of Liability
To the maximum extent permitted by applicable law:
- MedNest provides the Platform "as is" and "as available" without warranties of any kind.
- We are not liable for the quality, safety, or outcome of medical services provided by practitioners or clinics.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability shall not exceed the amount you paid to MedNest in the 12 months preceding the claim.
- We are not responsible for any loss of data, unauthorized access, or interruption of service.
15. Indemnification
You agree to indemnify and hold harmless MedNest, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.
16. Account Termination and Deletion
- You may deactivate or delete your account at any time through the app settings or by contacting support@mednest.ky.
- Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.
- We reserve the right to suspend or terminate your account at our discretion for violation of these Terms, fraudulent activity, or misuse of the Platform, with or without notice.
- Termination does not relieve you of any outstanding payment obligations.
17. Dispute Resolution
Any disputes arising from or relating to these Terms or the use of MedNest shall first be attempted to be resolved through good faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the rules of the relevant arbitration authority in the Cayman Islands. Class action lawsuits and class-wide arbitrations are not permitted.
18. Third-Party Services
The Platform may integrate with or contain links to third-party services, including payment processors, mapping services, and communication tools. These third-party services have their own terms and privacy policies. MedNest is not responsible for the content, privacy practices, or availability of third-party services.
19. Push Notifications
With your consent, we may send push notifications for appointment reminders, booking confirmations, payment receipts, and important platform updates. You can manage notification preferences in the app settings or through your device settings at any time.
20. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email, in-app notification, or by posting a notice on the Platform at least 14 days before the changes take effect. Continued use of the Platform after the effective date of changes constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Platform.
21. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
22. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Cayman Islands, without regard to conflict of law principles.
